Is Face Swapping Legal? What the Law Says Where You Live

Yes. In most countries face swapping is legal when you use your own photos, or photos of people who agreed to it, for fun or personal use. It becomes illegal or risky when the result is sexual and made or shared without consent, when it's used to scam, deceive or impersonate someone, or when a person's face is used to sell something without permission. Some places now also require AI images to be labelled.
This page is general information, not legal advice. Every law below links to its official text, checked on October 27, 2026. Laws in this area change quickly, so if you're dealing with a real case, talk to a lawyer where you live.
When a face swap is usually fine
A face swap is usually fine when everyone whose face appears has agreed and nobody is misled. Putting your own face into a portrait template, swapping faces with a friend who's in on the joke, or making a birthday card for someone who'll love it are ordinary photo edits in almost every country.
- Your own face, in any template or photo you have the right to use.
- People who said yes, like friends or family who know what you're making and where it will go.
- Templates with AI-generated people. The people in Face Swap AI's templates aren't real individuals, so no one else's likeness is involved.
When a face swap can break the law
A face swap can break the law when it hurts someone who didn't agree to it. Sexual images made or shared without consent are a crime in a growing number of countries, and fraud, harassment and defamation laws apply to fakes the same way they apply to anything else.
- Sexual or nude images without consent. A specific crime in the US, the UK, France, South Korea and others (see the table below).
- Any sexual image involving a minor. Illegal everywhere, whether real or fake.
- Scams and impersonation, such as a fake photo used to ask for money or to pose as someone online.
- Harassment and defamation, such as a fake that makes someone look like they did something they didn't.
- Ads and endorsements. Using a real person's face to sell something without permission can break image rights or right of publicity laws.
Face swap and deepfake laws by country
The laws written for deepfakes focus on two things: sexual images made without consent, and labelling AI content. Here's what the main laws say, each checked on October 27, 2026 against its official source.
- United States (federal). Publishing a sexual "digital forgery" of a real person without consent is a federal crime: up to 2 years in prison, or 3 if the person is a minor. Platforms had one year to set up a removal process and must take a reported image down within 48 hours. Source: TAKE IT DOWN Act, Public Law 119-12, approved May 19, 2025.
- United Kingdom. Since February 6, 2026, creating, or asking someone to create, a sexually explicit fake image of an adult without their consent is an offence, even if the image is never shared. Source: Data (Use and Access) Act 2025, s.138 (Sexual Offences Act 2003, s.66E and 66F).
- European Union. AI image tools must mark what they make in a machine-readable way. People who publish a deepfake must say it's AI, with a lighter duty for clearly artistic, satirical or fictional work. Purely personal, non-professional use is outside the Act. Applies from August 2, 2026; tools already on the market have until December 2, 2026 to add the marking. Source: AI Act, Art. 50, Art. 2(10) and Art. 111(4), Regulation (EU) 2024/1689.
- France. Sharing a fake of someone's image or words without their consent, when it isn't obvious it's fake, is an offence (art. 226-8). Sexual deepfakes have their own offence (art. 226-8-1). Both were updated for AI-generated content by the SREN law of May 21, 2024. Source: Code pénal, art. 226-8 and 226-8-1 (Légifrance).
- Brazil. The penalty for psychological violence against a woman goes up by half when the crime uses AI or any technology that alters the victim's image or voice. Source: Lei nº 15.123, April 24, 2025 (Código Penal, art. 147-B).
- China. Since September 1, 2025, AI services must label AI-generated and synthetic content, including images, with visible labels and with hidden labels in the file's data. Source: Measures for Labeling AI-Generated Synthetic Content (Cyberspace Administration of China).
Not in the table? Many countries have no law written for deepfakes yet, but their general laws on privacy and image rights, defamation, harassment, fraud and child protection still cover harmful face swaps. South Korea, for example, punishes making and sharing sexual deepfakes and, since 2024, possessing or watching them too, as reported by Korea JoongAng Daily. In the US, many states also have their own laws on sexual deepfakes and on using someone's likeness.
Do you have to label an AI face swap?
Sometimes. In the EU, if you publish a face swap that could pass as a real photo, you have to say it was made with AI, unless it's purely personal use. China requires AI services to label their output. Elsewhere it's rarely a legal duty for you, but many social apps require it in their rules, and it's the honest thing to do.
Face Swap AI adds a machine-readable AI label to every download (the IPTC Digital Source Type in the file's metadata). Apps often strip metadata when you edit or post a photo, so if you share a swap publicly, add a short note such as "edited with AI" too. Our terms ask for that.
Can I face swap a celebrity or public figure?
For a private joke, it's rarely a crime. Publishing it is riskier: famous people's image rights and publicity rights still apply, especially in ads or anything that suggests they endorse you. A sexual or deceptive fake is illegal whoever the person is, and election rules in some places add limits on fakes of candidates.
What to do if someone face swapped you
If someone made a face swap of you without asking, save the evidence first, then report it to the site or app where it appears. If it's sexual, threatening or part of a scam, report it to the police as well. You can also ask the person who posted it to take it down, if that feels safe.
- Save evidence: screenshots, links, usernames and dates, before anything is deleted.
- Report it to the platform. In the US, platforms must remove a reported sexual fake within 48 hours of a valid request under the TAKE IT DOWN Act.
- Get help from the police for sexual images, threats or fraud, and from a lawyer if you want to claim damages.

How Face Swap AI handles this
Face Swap AI is built for swaps you're allowed to make: your own face in a template, or two photos you have the right to use. Our terms don't allow using it to impersonate someone or to make people believe something happened that didn't. Every download carries an AI label in its metadata, template photos show AI-generated people, and your uploaded photos aren't kept after the swap (see how your photos are handled).
Questions
Is it illegal to face swap someone without permission?
Not always. A private, harmless joke usually isn't a crime. It becomes illegal if the image is sexual, used to scam or impersonate them, damages their reputation, or uses their face to sell something. The safest rule is to ask first, and never share a swap of someone who said no.
Can I get in trouble for a face swap meme?
A meme that's obviously a joke and doesn't target a private person is rarely a problem. Trouble starts when it humiliates or harasses someone, looks like a real photo of something that didn't happen, or is sexual. In the EU, a realistic fake you publish should be labelled as AI.
Is face swapping legal in the EU?
Yes. The AI Act doesn't ban face swaps. It requires AI tools to mark their output and people who publish deepfakes to disclose them, with lighter rules for clearly artistic or satirical work and none for purely personal use. National laws, like France's, separately punish sexual deepfakes and deceptive fakes.
